2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 02.08.2023 passed in Cr. Misc. No. 22115 of 2023 .

3. The petitioner seeks regular bail in a case registered for the offence under Sections 304(B), 34 of the Indian Penal Code.

4. As per the prosecution case, the deceased has been killed by the accused persons.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He submits that nothing has come in the viscera report against the petitioner and the trial is delayed. The petitioner is the husband

6. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

7. Considering the facts and circumstances of the case as well as the period of custody of the petitioner, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge, II, Sitamarhi/concerned Court below in connection with Mahindwara P.S. Case No. 211 of 2022 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
