Although petitioner is said to have been caught by the informant when he along with his associates was making attempt to commit theft from the shop of the informant but according to the prosecution case itself, petitioner was produced before the police by the informant himself and nothing was recovered from conscious possession of the petitioner. Moreover, petitioner is in jail custody since 5.01.2016 and he does not have any criminal antecedent.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two
