JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-04-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 16.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Rampur P.S. Case no. 348 of 2019, registered under Sections 489(A), 489(B), 489(C), 489(D) and 489(E) of the Indian Penal Code and Section 30(A), 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The accusation is that on the basis of information received from accused Teju Yadav @ Mithilesh Kumar, quarter

No.35638 of 2020(2) dt.15-04-2021 2/3 No. 09-B of Jail Press quarter was searched from where printer, laptop for printing fake currency and fake currency of Rs. 200/- and Rs. 50/-, semi printed fake currency and ink recovered from there and several bottles of Indian Made Foreign Liquor in volume of 60 litres also recovered. At that place, Suresh Rajak was apprehended, who disclosed that the flat is taken on rent from one Lakhan Das and he is doing the work here along with Teju @ Mithilesh Kumar and Sandeep Kumar (Petitioner) prints the fake currency.

Learned counsel for the petitioner submits that petitioner was not apprehended on the spot, rather, the name of petitioner surfaced in the confessional statement of co-accused Suresh Rajak, who is said to be apprehended on the spot. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Excise Act, Gaya in connection with Rampur P.S. Case No. 348 of 2019, subject to the condition as laid down under Section 438
