The petitioner is not named in the F.I.R. and, according to the prosecution case, the F.I.R. named accused mercilessly assaulted the informant's son as a result of which the informant's son died. The name of the petitioner came in this case in course of investigation in the statements of the prosecution witnesses. The informant claims himself to be an eye-witness but being a co-villager of the petitioner, he did not name the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the
