JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Majhauliya P.S. Case No. 285 of 2018 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.
Allegation as per FIR is that local people intercepted one Guddu Kumar while he was committing theft of motorcycle and from his possession a master key was recovered and on the basis of his confession police raided the house of brother of the petitioner and recovered three motorcycles.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession and he has no criminal antecedent.
Heard learned APP, who has opposed the prayer for
Patna High Court CR. MISC. No.36967 of 2019(3) dt.16-08-2019 2/2 anticipatory bail of the petitioner.
In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.
Accordingly, this application is dismissed.
