JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners, learned counsel for the informant and the learned A.P.P. for the State. The petitioners are accused in connection with Gopalpur P.S. Case No. 90 of 2015, registered under Section 420 and 311 of the Indian Penal Code.
The prosecution case is that the petitioners and other approached the husband of the informant and introduced a third person as an officer of the Gopalganj Central Co-Operative Bank and petitioners also introduced themselves as Manager of Gopalpur PACS and they asked the informant to deposit the money on which 12% per annum interest will be provided and money will be withdrawn, whenever informant wants to
Patna High Court Cr.Misc. No.9850 of 2016 (3) dt.28-04-2016 2/2 withdraw. At that time, accounts were opened and money was deposited and withdrawn. Later on, both petitioners were found missing and both of them committed fraud with the complainant. Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in this case. Further submission is that petitioners are in custody since 06.01.2016.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Gopalpur P.S.
