The petitioner has preferred this application for grant of regular bail in a case registered under sections 419, 420, 468, 471 and 34 of the Indian Penal Code.

As per the prosecution case, at the competitive examinations being conducted for appointment in the police service, it is stated that one Pankaj Kumar was found giving examination in place of the petitioner.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The person caught giving examination in his place has been enlarged on bail vide order contained in Annexure 2. The petitioner is in

Patna High Court CR. MISC. No.33944 of 2022(5) dt.20-01-2023 2/2 custody since 2.6.2022 and charge sheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, his being in custody since 2.6.2022 and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Khagaria (Chitragupta Nagar) P.S. Case no. 741 of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
