JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 279, 304 A and 304 of the Indian Penal Code. According to prosecution case itself, the deceased met with an accident by the tractor which was being driven by the petitioner at the time of alleged occurrence. The impugned order of learned Sessions Judge reveals that petitioner was driving the tractor without having any valid license, but submission on behalf of the petitioner is that after the alleged occurrence, petitioner was caught by the local people and mercilessly assaulted and in that course, his all belongings including driving license were snatched by the mob.

No.11893 of 2016 (2) dt.17-03-2016 2/2 Moreover, considering the facts and circumstances of the case as well as submissions of the parties and also taking note of this fact that the petitioner is in jail custody since 6.12.2015, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabua in connection with Bhabua P.S. Case No.679 of 2015, G.R. No.2803 of 2015.
