JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners were neither caught on the spot nor anything was recovered from their conscious possession and they do not have any criminal antecedent but, even then, they are languishing in jail custody since 25.12.2015 only on the basis that the apprehended co-accused had disclosed the name of these petitioners.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S.Case No. 608 of 2015.
