JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Mofassil P.S.Case No. 323 of 2015 registered under Section 366/34 of the Indian Penal Code.
The prosecution case is that the daughter of the informant was kidnapped in course of sell of clothes by this petitioner and one Munna Thakur.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in the present case merely on suspicion. He further submits that, in fact, due to altercation the present case has been lodged after one month .Moreover, the daughter of the informant was about 20 years at the time of occurrence. It is further submitted that the
Patna High Court Cr.Misc. No.9723 of 2016 (3) dt.28-04-2016 2/2 victim and the informant has filed a compromise petition in the Court of learned C.J.M., Gaya on 16.12.2015. The petitioner has no criminal antecedent and he is in custody since 21.10.2015. Having considered the facts and circumstances of the case, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in Mofassil P.S.Case No. 323 of 2015.
