JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-12-2020 Heard Mr. Ganesh Prasad Singh, learned counsel for the petitioner and learned APP for the State. This is an application seeking modification of the order dated 24.07.2020 passed by this Court in Criminal Miscellaneous No. 21077 of 2020.

The petitioner was granted anticipatory bail by the aforesaid order but with the condition that he ought to surrender before the Court below within a period of six weeks from the date of passing of the order.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.27172 of 2020(2) dt.09-12-2020 2/2 that though he made an online application for surrendering before the court below but the same was not taken into account. Learned counsel, therefore, requests for extension of the period for the petitioner to surrender before the court below to seek bail.

For the reasons stated in the application, the prayer is allowed. The order dated 24.07.2020 is modified to the extent that if the petitioner surrenders before the Court below within a period of eight weeks from today, he shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kudhani (Turki O.P.) P.S. Case No. 47 of 2020 subject to the condition laid down under Section 438(2) of the Cr.P.C. The petition stands allowed to the extend indicated above.
