JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner is not named but submission on behalf of the petitioner is that except confessional statement of coaccused persons as well as some criminal antecedents of the petitioner, there appears to be nothing against him. From perusal of the impugned order it would appear that the learned Additional Sessions Judge has written a very long and detailed order but he failed to mention as to how the name of the petitioner came in this case.

Moreover, considering the aforesaid submissions as well as facts and circumstances, particularly keeping in mind that the petitioner is in jail custody since 17.09.2014, but up till now he has not been put on Test Identification Parade in the present case,

Patna High Court Cr.Misc.
