The petitioner seeks bail in connection with Kasim Bazar P.S. Case No. 144 of 2013 registered under Section 414 of the Indian Penal Code, Section 25(1-B)(a), 26(i)(ii) of the Arms Act and Section 17/12 of the Unlawful Activities (Prevention) Act.
The prayer for bail of the petitioner was earlier rejected by this Court on merits vide order dated 15.05.2014 passed in Cr. Misc. No. 7601 of 2014.
It has been contended that though the petitioner has
Patna High Court Cr.Misc. No.18134 of 2015 (4) dt.08-07-2015 2 / 2 remained in custody for about two years, charges have not been framed till date. It has further been contended that some other accused persons have been granted bail either by this Court or by the court below.
Be that as it may, regard being had to the reasons assigned in the aforesaid order dated 15.05.2014, I am not inclined to grant bail to the petitioner for the present. In case the trial is not concluded within six months from the date of framing of charge, the petitioner would be at liberty to renew his prayer for bail.
