JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 This application, for grant of anticipatory bail, arises out of Bheldi P.S. Case No. 63 of 2019, disclosing offences under Sections 447, 448, 354, 379 and 506of the Indian Penal Code.
Allegation as per F.I.R is that while the informant was sleeping, petitioner entered inside the house and tried to misbehaved with her and also started strangulating her and further snatched away golden chain and mangalsutra. Submission of learned counsel for the petitioner is that he is the friend of son of informant and there is dispute between her son and the petitioner with regard to fishing and due to which, he has falsely been made accused in this case and further the allegation does not appear to be probable as at one hand, she alleged that petitioner tried to misbehave with her and

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -12, Saran, Chapra, in connection with Bheldi P.S. Case No. 63 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
