JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Para 20 of the case diary reveals that victim along with her husband appeared before the officer in charge of concerned police station and after that her statement under Section 164 of the Cr.P.C. was recorded in which she stated that she was taken to Guwahati by the petitioner and other accused and with the help of Guwahati police, she was recovered from possession of the petitioners.

Petitioners are in jail custody since long and admittedly, the victim was major at the time of alleged occurrence and prior to her statement recorded under Section 164 of the

Patna High Court Cr.Misc. No.17052 of 2015 (4) dt.15-09-2015 2/2 Cr.P.C. she had already come in touch of her husband. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Paroo P.S.
