JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the statement of one Ram Prakash Sharma was recorded and the said Ram Prakash Sharma disclosed that this petitioner had taken his signature on plain form of concerned bank and withdrew the amount from his account for which he lodged a criminal case against the petitioner as well as Branch Manager of the concerned Bank and on the basis of aforesaid statement, petitioner has been remanded in this case. Learned counsel for the petitioner submits that petitioner has already been admitted to anticipatory bail in the case

Patna High Court Cr.Misc. No.17080 of 2015 (5) dt.03-09-2015 2/2 which was lodged by the aforesaid Ram Prakash Sharma whereas he is languishing in jail custody in the present case since 10.02.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Adapur P.S.
