Petitioner has renewed his prayer for bail on the ground that Sonu Kumar, on whose confessional statement petitioner has been apprehended, had already been granted bail vide Cr. Misc. No.42824 of 2014. As such, petitioner should be released on bail.

On the other hand learned Additional Public Prosecutor opposes the same.

At an earlier occasion vide order dated 07.11.2014 passed in Cr. Misc. No.29162 of 2014 prayer for bail of petitioner was rejected taking into account the facts exposed at his inculpatory extra judicial confessional statement leading to recovery of Tata Magic under para-69, 70 of the case diary as well

Patna High Court Cr.Misc. No.18173 of 2015 (2) dt.11-05-2015 as recovery of dead body of deceased driver under para-75 of the case diary. The case of the petitioner in the aforesaid background is clearly distinguishable from the case of Sonu Kumar who had already been granted bail.

That being so, prayer for bail is rejected.
