Informant, who is not an eye witness, had disclosed that on 17.09.2013, on getting information from co-villagers, rushed to his house where his parents have disclosed that on account of partition of ancestral property, his uncle Mahendra Thakur, aunt Anarwa Devi and cousin Shyam Babu Thakur (petitioner) and Ram Babu Thakur assaulted with lathi and Danda to his father. He had taken to his father to Primary Health Centre, Kanti for treatment and from there to Private Nursing Home. Subsequently thereof, deceased was taken to S.K.M.C.H. where he died on 04.10.2013.

In the aforesaid facts and circumstances of the case, petitioner, Shyambabu Thakur is directed to be released on bail

Patna High Court Cr.Misc. No.17616 of 2015 (02) dt.13-05-2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No.397 of 2014 arising out of Kanti P. S. Case no.356 of 2013.
