The petitioner seeks his bail in Derni P.S.Case No.06 of 2015 registered under Sections 302/34 of the Indian Penal Code. It is alleged that the petitioner was also involved in killing of the deceased.
It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR, his named transpired in course of the investigation on the confessional statement of co-accused. Except for this, there is no direct or indirect allegation against the petitioner. There is no circumstantial evidence to suggest the involvement of the petitioner in the present case. The petitioner has got no criminal antecedent and is in custody since 8.2.2015. On behalf of the State it has been submitted that the petitioner is named in the F.I.R. having an active role in the crime. Considering the facts aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Derni P.S.Case No.06 of 2015.
