JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 323, 427, 341, 379/34 of the Indian Penal Code and Section 3 (i) (x) of S.C./S.T. (Prevention of Atrocities) Act.
It is a case of misuse of privilege of bail only for one day but it is alleged that petitioner made himself absent from the trial when a witness appeared to depose against him. Moreover, on the very next day, petitioner surrendered before the trial court and is languishing in jail custody since long.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.10938 of 2016 (2) dt.09-03-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge-cum-1st Additional Sessions Judge, Gopalganj in connection with Bhore P.S.
