JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Banka P.S. Case No. 54 of 2019, disclosing offences under Sections 366/34 of the Indian Penal Code. Allegation of kidnapping the minor daughter of the informant against the son petitioners and it is also said that in the F.I.R. that the petitioners also assisted in kidnapping the minor daughter of the informant. It further appears that earlier a Co-ordinate Bench of this Court has granted provisional bail to the petitioners on the assurance of the petitioners that they will find out whereabouts of their son.

Submission of learned counsel for the petitioners is that they have tried to ascertain the whereabouts of their son, though they came to know that their son has married with the

Patna High Court CR. MISC. No.31817 of 2019(3) dt.25-07-2019 2/2 daughter of the informant, but they could not ascertain whereabouts of them. They are only father and mother and they are ready to co-operate in the investigation. Heard learned APP also.

Having heard both sides, considering the above facts and circumstances, as stated above, so far as, petitioner no.2 is concerned, who is mother and lady, the provisional bail granted to the petitioner no.2, vide order dated 15.05.2019 is confirmed. So far as, petitioner no.1 is concerned, provisional bail granted to him is recalled. He is directed to surrender before the learned court below and make prayer for regular bail.
