JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Petitioner is languishing in custody since 16.02.2015 in a case registered for the offences punishable under Sections 379, 411, 420 of the Indian Penal Code and Section 66(C) of the I.T. Act.

The prosecution case is that the informant went to withdraw money from A.T.M when this petitioner got the A.T.M changed and subsequently informant received massage on his mobile with regard to withdrawal of Rs. 30,200/-. Thereafter the petitioner was arrested on the spot from whose possession A.T.M of different banks of different persons were recovered. The complicity of the petitioner further gets corroborated from the C.C.T.V footage.

It is submitted by learned counsel for the petitioner that nothing on the record suggests the actual withdrawal made by the petitioner. It is further submitted that investigation has already concluded.

Patna High Court Cr.Misc. No.16261 of 2015 (2) dt.22-05-2015 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent and after filing of the present bail application a case has been registered against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 134 of 2015.
