The petitioner seeks bail in Babubarhi P.S. Case No.31 of 2009 registered under Section 302 and 201/34 of the Indian Penal Code.

The prosecution case, in brief, is that one Shiv Kant Chaudhary had filed a written petition before the S.H.O. Babubarhi P.S. alleging that a dead body of woman was found on the railway track. In the course of investigation, witnesses have stated that co-accused including the petitioner had committed murder of the deceased and her dead body was thrown near the railway line.

It is submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.16250 of 2015 (2) dt.10-06-2015 petitioner is the father-in-law of the deceased. It has further been submitted that the dead body of the deceased was found lying on the railway track and there is no eye witness to the said incident. The petitioner has been implicated in the present case only for the reason that he is the father-in-law of the deceased and the entire case is based upon suspicion. There is no direct or indirect evidence to suggest the implication of the petitioner in the present case.

On behalf of the State, it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ravi Shankar, J.M., Ist Class, Madhubani in Babubarhi P.S. Case No.31/2009 corresponding to G.R.No.437/2009.
