The petitioners of both these applications seek bail in connection with Sitamarhi P.S. Case No.144 of 2015 for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code.
The prosecution story, in brief, is that on 17.02.2015 at
Patna High Court Cr.Misc. No.16535 of 2015 (2) dt.10-06-2015 2/3 about 20.30 hours, one Meghu, who is a resident of the informant's Mohalla, came to his house by motorcycle and said that his brother is in injured condition lying near Raghunath Jha College. The informant went there and found his brother lying in injured condition and unconscious. Thereafter the informant's brother was taken to Sadar Hospital where the doctor declared him dead.
It has been submitted on behalf of the petitioners that the petitioners are not named in the first information report and subsequently, their names have figured during course of investigation. It has further been submitted that there is no direct and indirect evidence against them nor there is any circumstantial evidence to suggest their implication in the present case. It has further been submitted that the petitioners have got no criminal antecedents and they are in custody since 23.02.2015. On behalf of the State it has been submitted that the names of the petitioners have figured during course of investigation and they have played active role in the crime. Considering the aforesaid facts and circumstances of the case, let the petitioners of both the applications, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to
