The petitioner seeks bail in connection with Complaint Case No. 969/2011 for the offences punishable under section 406 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.
The prosecution case, in brief, is that the informant had lent Rs.2,00,000/- to the petitioner on the assurance of returning
Patna High Court Cr.Misc. No.16428 of 2015 (2) dt.10-06-2015 2 / 2 the same, but he did not return the money on repeated demand, and subsequently the petitioner had issued a cheque of rupees one lakh in favour of the informant, which was bounced due to inadequate fund in the account.
It has been submitted on behalf of the petitioner that the petitioner is ready to deposit the amount of rupees one lakh in the court below, which may be subject to the final disposal of the case.
It is further submitted that the petitioner is in custody since 8-10-2014.
On behalf of the State, it has been submitted that the petitioner is named in the complaint.
Considering the fact that the petitioner is ready to deposit the amount of rupees one lakh in the court below, which may be subject to the final disposal of the criminal case, let the petitioner be released on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad, in connection with Complaint Case No., 969/2011.
