2. The petitioners apprehend their arrest in a case registered for the offence under Sections of the 126(2), 115(2), 117(2), 108 of Bhartiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that the grandson of the informant namely Azad Kumar committed suicide by hanging and the reason was that his wife Kajal Kumari had gone to the house of her fufa (uncle). When on the next day, the deceased went to take her back, it is alleged that the petitioners along with other co-accused persons assaulted him, due to
Patna High Court CR. MISC. No.50147 of 2025(3) dt.01-09-2025 2/3 which, he received injuries and when informant returned after taking medicine for him, she saw the dead body of her grandson hanging and she started raising alarm.
4. Learned counsel for the petitioners submits that informant is not eye-witness to the occurrence and has raised only suspicion against petitioners and other co-accused persons. He further submits that though, as per F.I.R., all the named accused persons assaulted the deceased, but doctor has not found any external injury on the person of deceased, rather as per post-mortem report, the cause of death is 'Axphyxia'. Three similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 01.08.2025 passed in Cr.Misc. No. 46480 of 2025. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Danapur (Patna) in
Patna High Court CR. MISC. No.50147 of 2025(3) dt.01-09-2025 3/3 connection with I.I.T. Amhara P.S. Case No. 18 of 2025, subject to condition as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
