The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366A and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was kidnapped by the petitioner for the purpose of marriage.

The case of the petitioner is that the petitioner has been falsely implicated in the case. He is in custody since 22.4.2022 and has no criminal criminal antecedent. Heard learned APP for the State.

Having heard learned APP for the State and on perusal of the materials on record, it transpires that the daughter of the informant was recovered and her statement was recorded under

Patna High Court CR. MISC. No.33970 of 2022(3) dt.13-01-2023 2/2 section 164 Cr.P.C which has been mentioned in paragraph no. 51 of the supplementary case diary in which the informant's daughter has not supported the prosecution case and has stated that she went with the petitioner out of her own volition. In view of the aforesaid facts of the case especially the contents of the statement of the daughter of the informant under section 164 Cr.P.C, the petitioner being in custody since 22.4.2022 and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Goraul P.S. Case no. 170 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Vaishali at Hajipur.
