This is a petition for grant of regular bail in a case under Section 414 of the Indian Penal Code and under Sections 25 (1-B)a, 26 and 35 of the Arms Act.
It is alleged that a loaded country made pistol along with five live cartridges of 315 Bore was also recovered from the right pocket of pant of the petitioner.
It is submitted on behalf of the petitioner that at the request of Mukhiya namely Anil Singh to catch terror of the district namely Binod Thakur and Jitendra Nut against whom several cases are pending for committing theft of she-buffalo and they were going to hand over both of them to police and on the way, they were caught by the police. It is further submitted that
Patna High Court Cr.Misc. No.13266 of 2016 (2) dt.01-04-2016 2/2 the other co-accused persons have been granted bail by the Court below and the petitioner is in custody since 08.11.2015. Having regard to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail on behalf of the petitioner is hereby rejected in connection with Sasaram (M) P.S. Case No.1250 of 2015 pending in the court of learned Chief Judicial Magistrate, Sasaram. (Gopal Prasad, J.) Amit/- U T
