The petitioner apprehends his arrest in Belhar P.S. Case No.348 of 2018 registered under Sections 379, 414 of the Indian Penal Code and under Section 21 of Mines and Minerals Regulations and Development Act.

The name of the petitioner does not figure in the F.I.R.. Petitioner is the owner of the tractor. The tractor loaded with sand was seized.

The learned counsel for the petitioner submits that driver of the tractor was carrying sand on hire. Petitioner has no manner of concern with the sand.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender
