For issuance of appropriate writ /writs, order/orders, direction/directions to quash the notice dated 02.05.2023 contained in Memo No.194 issued under the Signature of Circle Officer, Ramnagar West Champaran (Respondent No.4) whereby and whereunder the petitioner was directed to vacate the shop and hand over the same to respondent No.5.

(ii). To direct the respondent authorities not to dispossess the petitioner frrm the shop, appertaining to Khata No.25, Khesra No.372,

The learned counsel for the Respondent-State seeks to file a counter affidavit, which is taken on record, wherein it has been stated that the impugned order dated 23.11.2020, passed by the Circle Officer, Ramnagar, directing the petitioner to hand over the possession of the shop in question to the Respondent No. 5 has been recalled, hence, nothing survives for consideration in the present case.

The learned counsel appearing for the petitioner has not disputed the aforesaid factual situation, as has been averred by the learned counsel for the Respondent-State and submits that now, the petitioner is not having any subsisting grievances. 4.
