The petitioner seeks his bail in Excise Case No.27 of 2015 registered under Section 45(A) of the Excise Act. The petitioner has been apprehended on the allegation that on search by the police party of his house, 200 liters of illegal wine and 200 kgs. of Jawa Mahua kept in 10 separate containers, one machine for making wine including aluminum were recovered.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and is in custody since 1.3.2015. Whatever is said to have been recovered, i.e. from the house of maternal uncle of the petitioner. It has been submitted that the petitioner may be released on bail after competition of six months in custody.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid, the petitioner, named
Patna High Court Cr.Misc. No.16622 of 2015 (2) dt.11-06-2015 2/2 above, is directed to be released on bail after completion of six months in custody on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Excise Case No.27 of 2015.
