In this case, the petitioner is seeking bail in connection with S.T. Case No. 344 of 2014 arising from K. Nagar P.S. Case No. 510 of 2012 registered for offences under Sections 147, 148, 149, 341, 342, 323, 504, 506, 379, 384, 386 and 387 of the Indian Penal Code.

From the first information report it appears that the accused persons including the petitioner apprehended the informant, confined him in the custody, dragged, assaulted and took an amount of Rs. 1800/- from his possession and also demanded Rs. 5,00,000/- as levy amount, so much so, they obtained his signature on plain paper and later on, the petitioner was arrested. The petitioner carries six cases over his head.

Patna High Court Cr.Misc. No.16716 of 2015 (2) dt.15-06-2015 2/2 The counsel for the petitioner submits that the petitioner is in custody since 5th December 2013 in the present case.

Looking to the period of custody of the petitioner, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge, VIII, Purnea in connection with S.T. Case No. 344 of 2014 arising from K. Nagar P.S. Case No. 510 of 2012, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
