On getting confidential information regarding assemblage of anti-social elements for the purpose of planning, commission of dacoity, raid was conducted and during course thereof, three persons were apprehended amongst whom petitioner is one of them while remaining succeeded in their escape. On search, from possession of Prem Singh (Petitioner) as well as Ajay Kumar countrymade loaded pistol along with other articles in terms of seizure list while from the possession of Mahabir Sah cartridges along with mobile etc. were seized for which seizure list was prepared. Though, petitioner has got chequered history however taking into account the period of detention since 26.08.2014 petitioner Prem Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
Patna High Court Cr.Misc. No.17713 of 2015 (2) dt.14-05-2015 each, to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No.239 of 2014, subject to condition that he will have to present before the Goraul Police Station at every fortnight and will place the certificate issued by the Goraul Police Station to the learned lower court regularly. In case of failure at the end of the petitioner, will deprive him to enjoy the privilege of bail furthermore. To have effective compliance of the order one of the bailor should be a Government servant.
The Chief Judicial Magistrate, Vaishali at Hajipur is directed to serve a copy of the order upon the Goraul Police Station for effective compliance.
