The petitioner apprehends his arrest in connection with Sahebganj P.S. Case No.402 of 2018 registered under Sections 399, 402 and 412 of the Indian Penal Code besides Sections 25(1-b)a, 26 and 35 of the Arms Act. The accusation is that in course of patrolling duty, when the informant along with other police personnel reached on the main road, then saw six persons sitting there with two motorcycles. On seeing the police party, they started to flee away but on chase four persons were apprehended and, on query, they disclosed their name as Kundan Giri, Vikky Kumar, Nitesh Patel and Sachin Kumar. On search, they were found in

Patna High Court CR. MISC. No.35737 of 2019(3) dt.04-07-2019 2/2 possession of arms and ammunitions. They also disclosed the name of the petitioner, who succeeded to flee away. Learned counsel for the petitioner submits that neither the petitioner was apprehended on the spot nor any incriminating material was recovered from his possession. The name of the petitioner name has been disclosed by the apprehended co-accused.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, West Muzaffarpur, in connection with Sahebganj P.S. Case No.402 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
