Unknown miscreants looted away truck as well as personal belongings of informant regarding which police was informed whereupon the police swung into action, apprehended the vehicle along with two miscreants. On their search, recovery happens to be in terms of seizure list. On their confessional statement, truck was seized, however, the articles kept upon the truck was removed.

It is apparent from the fard-beyan itself that the name of petitioner cropped up on account of inculpatory extra-judicial confessional statement of co-accused being a driver of Safari vehicle through which the miscreants chased the truck. Chargesheet had already been submitted. Petitioner happens to be

Patna High Court Cr.Misc. No.17157 of 2015 (02) dt.01-05-2015 under custody since 24.12.2014, having no criminal antecedent as is evident from Paragraph-3 of the petition.

Accordingly, petitioner Md. Raqueeb is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.
