JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, he was arrested and one MicroMax mobile and Rs.1000/- in cash are said to have been recovered from conscious possession of the petitioner.
Learned counsel for the petitioner submits that the seized mobile is not the looted property because according to the prosecution case itself, the Samsung mobile was snatched by the culprits.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with
Patna High Court Cr.Misc. No.10413 of 2016 (2) dt.04-03-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S.Case No. 375 of 2015.
