JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner came in this case in confessional statement of co-accused, which is evident from perusal of para-25 of the case diary and except the aforesaid confessional statement as well as confessional statement of the petitioner, there appears to be nothing against him. The learned Additional Sessions Judge has mentioned in his impugned order that dead body of the deceased has been recovered on the basis of confessional statement but the confessional statement of petitioner was recorded much after the institution of the present case and according to FIR itself, it is clear that dead body of deceased had already been recovered at the
Patna High Court Cr.Misc. No.17181 of 2015 (3) dt.15-09-2015 2/2 time of institution of the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Bihta P.S. Case No. 421 of 2014.
