Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Raghopur P.S. Case No. 404 of 2022 registered for the offence under Sections 461 and 379 of the Indian Penal Code however the charge-sheet has been submitted under Sections 461, 379 and 411 of the IPC.
As per the prosecution case, theft has been committed in the shop of one Sanju Kumar and many articles were stolen.
Learned counsel for the petitioner submits that the petitioner is in custody since 29.10.2022 and the petitioner is not
Patna High Court CR. MISC. No.35089 of 2023(2) dt.12-07-2023 2/2 name in the F.I.R.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, Supaul/concerned Court below in connection with Raghopur P.S. Case No. 404 of 2022 subject to the condition:- (I) The petitioner will mark his attendance at the Raghopur Police Station, Supaul on each Sunday of each month.
