The petitioner is languishing in custody since 04.02.2014 for the offences instituted under Sections 427/380 of the Indian Penal Code.

The prosecution story, in brief is that cousin brother of the informant is living in Orissa and in the night of 18.11.2014, some unknown persons committed theft in his house after breaking the lock of the door and household article were stolen from the house. First Information Report has been instituted against unknown persons, but during the course of investigation name of the petitioner has come.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.19123 of 2015 (3) dt.02-09-2015 P2/2 petitioner that the petitioner is in custody since 04.02.2014. Chargesheet has been submitted. Petitioner has no criminal antecedent. The name of the petitioner has come during the course of investigation.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Aurangabad in connection with Haspur P.S. Case No. 113/14.
