JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to prosecution case itself, the marriage of deceased had taken place with petitioner in the year 2004 whereas she died in the year 2015 i.e. after eleven years of her marriage. Although, informant claims that her daughter was subjected to cruelty and done to death due to non fulfilment of illegal demand and in course of investigation, it came to light that deceased died of burn injuries but between the year 2004 to 2015, not a single complain of illegal demand was made either by the informant or by the deceased. Moreover, petitioner is in jail custody since long and the charge against him has already been framed.

No.10289 of 2016 (2) dt.03-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Rohtas (Sasaram) in connection with Sessions Trial No. 339 of 2015 arising out of Kargahar (Barahari O.P.) P.S. Case No. 09 of 2015.
