2.The petitioners are named in the F.I.R. and apprehending their arrest in connection with Andramath P.S. Case No. 181 of 2024 registered for the offences punishable under Section 126(2), 115(2), 118(1), 109, 351(2), 351(3), 3(5) of BNS.

3. As per FIR, the allegation against petitioners is to assault informant and others by using spade, lathi etc. causing head and bodily injuries with intention to cause their death.

It is submitted by learned counsel appearing on behalf of the petitioners that alleged occurrence was free fight in nature where both parties received injuries and for same set of occurrence petitioners side also lodged a case against informant and others, which was registered as SC/ST P.S. Case No. 100 of 2024 dated 17.12.2024. It is submitted that the allegation as to assault informant is available against petitioner no. 2 which upon medical examination found simple. It is further submitted that assault not appears repeated prima-facie negating intention to cause death. While concluding arguments, it is submitted that petitioners claimed their antecedents as clean.

5. Learned APP, opposed the prayer of bail.

6. In view of aforesaid factual submissions and by taking note of fact as the occurrence appears primafacie free fight in nature, where the injuries as alleged to be inflicted by petitioner no. 2 upon informant found simple in nature, accordingly petitioners above-named, in

No.34186 of 2025(2) dt.22-05-2025 3/3 the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani/concerned Court, where the case is pending in connection with Andramath P.S. Case No. 181 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of BNSS.
