Petitioner is not named in the first information report but in course of investigation, he was arrested and it appears that confessional statements of petitioner and some other accused were recorded. Moreover, petitioner was put on T.I.P but he was not identified by the victim and it is alleged that petitioner did work of liner in the alleged crime as he was in constant touch with F.I.R named accused Mantu Das.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, cum Sub Judge-III, Muzaffarpur in
