The petitioner seeks bail in a case under Section 290 of the Indian Penal Code and Section 47(A) of the Excise Act. About 80 cartons of foreign liquor were being found to be carried in a pick-up van bearing registration No. BR 11 S6576. Awadhesh Kumar Yadav was driver of the van. The petitioner is said to be owner of the vehicle. The petitioner is in custody since 07.03.2015 and he has already remained in jail for more than three months. The accusation is that he is owner of the vehicle in which foreign liquor was being carried away.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner
Patna High Court Cr.Misc. No.20174 of 2015 (3) dt.03-07-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.
