Petitioner is not named in the first information report but admittedly, kidnapped boy returned to his home safely and his statement has been recorded under section 164 of the Cr.P.C but kidnapped boy has stated nothing against the petitioner. Petitioner and the informant are co-villagers. It appears that in course of investigation brother of the informant claimed that call of ransom was given through mobile phone bearing no. 7765968916 and the aforesaid mobile belongs to the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be

Patna High Court Cr.Misc. No.17344 of 2015 (3) dt.03-09-2015 released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Miss. Kalpana Srivastava, Judicial Magistrate, Ist Class, Gaya/ concerned court in Paraiya P.S. Case no. 112/2014.
