01-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in CIS No. 103 of 2021, arising out of Gaya Excise P.S. Case No. 103 of 2021, registered for the offence under Section 30(a) & 56(B) of Bihar Prohibition and Excise Act.

1400 liters of spirit has been recovered from a pickup van and this petitioner was apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said pick-up van. Petitioner has got clean antecedent and he is in custody since 17.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.43742 of 2021(2) dt.01-11-2021 2/2 Considering the nature of allegation, period of custody and clean antecedent of the petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IInd cum Spl. Judge, Excise, Gaya in connection with Gaya Excise P.S. Case No. 103 of 2021.
