The petitioner seeks bail in connection with Rajiv Nagar P.S. Case No. 385 of 2015 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341, 387, 448, 504, 506, 307, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

On behalf of the petitioner it has been submitted that the petitioner is not named in the first information report. In course of investigation on the basis of confidential information the petitioner and Robin Kumar were apprehended and thereafter the confessional statement of the petitioner was got recorded forcefully and except confessional statement of the petitioner there is nothing against him, co-accused Robin Kumar has already been

Patna High Court Cr.Misc. No.11404 of 2016 (3) dt.28-04-2016 allowed bail vide Cr. Misc. No. 9238 of 2016 by another coordinate Bench of this Court and as such the petitioner deserves sympathetic consideration to which learned APP submits that the petitioner is involved in one more case.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Saurav Kumar Verma, J. M. Ist Class, Patna in connection with Rajiv Nagar P.S. Case No. 385 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
