====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 120(B), 34 of Indian Penal Code and Sections 3 and 4 of Explosive Substance Act. As per FIR dated 21.03.2021, when the informant was in his balcony this petitioner along with other accused persons allegedly threw bombs at boundary wall and balcony of the informant.
Learned counsel appearing for the petitioner submits that no one has received any explosive injury and the petitioner is innocent and has falsely been implicated in this case because of previous disputes between the parties. Petitioner has got clean antecedent.
Considering the allegation and fact that no one

No.34234 of 2022(2) dt.01-11-2022 2/2 sustained injury, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhagalpur in Nathnagar (Lalmatia) P. S. Case No. 447 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
