JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the father of the husband of the victim is languishing in jail since 04.01.2016 in a case registered for the offences punishable under Sections 498A, 304B and 201/34 of the Indian Penal Code.

The prosecution case is of killing the sister of the informant and disposing the dead body after about three years of the marriage for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner hat the informant came to know about the occurrence on 01.07.2014 when this petitioner conveyed to the informant that his sister eloped with someone when the FIR was registered on 22.07.2014. The informant has subsequently retracted from his initial version

Patna High Court Cr.Misc. No.10657 of 2016 (2) dt.03-03-2016 2/2 and filed a petition to that effect before the learned court below. Moreover, the investigation has already concluded. Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-IX cum ACJM, Muzaffarpur in connection with Shiwaipatti P.S.
