JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 19.10.2015 in a case registered under Section 366A of the Indian Penal Code. The statement of the victim has been recorded under Section 164 of the Cr.P.C. in which she stated that she was taken away by co-accused Tamanna and Rabina near a shop where petitioner and one co-accused Mahboob were present and the aforesaid co-accused gave her intoxicated substance as a result of which she became unconscious. However, she has admitted in her statement that on 19.10.2015, she was dropped by her kidnappers near Nautar Police Station. She has not made any complain of ill
Patna High Court Cr.Misc. No.11666 of 2016 (2) dt.15-03-2016 2/2 behaviour and the victim was found aged about 15 years to 17 years in her medical examination.
Submission on behalf of the petitioner is that the fact of the present case reflects that there was some affair of the victim. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties and also taken note of this fact that the investigation of the case has already been completed, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., West Champaran, Bettiah in connection with Bettiah Muffasil (Manualpur) P.S. Case No.574 of 2015.
