JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 11.06.2015 in a case registered for the offences punishable under sections 494, 498A, 366(A), 376 of the IPC.
The prosecution case is that the petitioner, being the husband of informant, used to torture the informant for dowry demands even after four years of the marriage. It is alleged that on 11.06.2015 at 6.00 A.M. the informant came to know that her husband eloped with her sister, Manti Kumari, thereafter the informant and her brother went to Baliyari Gufa and caught the petitioner with her sister Manti Kumari. On enquiry, the petitioner disclosed that he has married with the sister of informant. It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.10708 of 2016 (3) dt.18-04-2016 2/2 only on suspicion the accusation has been levelled. Learned APP, after going through the case diary, submits that the victim in her statement under section 164 of the Cr. P.C stated that she was being abducted by the petitioner and on being conclusion of investigation charge sheet under section 494, 498A, 366A, 376 of the IPC has been submitted against the petitioner.
In view of above, this court is not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is rejected. Let the trial be expedited.
